Solidarity to Earth First!: “non puoi citare in giudizio un’idea”

Lo studio legale Kasowitz Benson Torres, curatore degli interessi del presidente statunitense Donald Trump, ha intentato una causa contro Earth First! Journal: piattaforma informativa simbolo e promotrice del biocentrismo, della green anarchyst, dell’azione diretta senza alcun compromesso con quelle corporazioni che distruggono la Terra.
L’azione legale è stata avviata su richiesta delle multinazionali energetiche Energy Transfer Partners (ETP) e Energy Transfer Equity (ETE), entrambe proprietarie del progetto Dakota Access Pipeline: il gasdotto di 1.200 che attraversa il Nord Dakota (passando sotto al letto del fiume Missouri), la cui realizzazione ha condotto (lo scorso 22 febbraio) all’esproprio forzato e violento dei/delle Sioux.
L’accusa è tanto grave quanto ridicola e tira in ballo il terrorismo che, secondo i legali di Trump, Earth First! avrebbe direttamente finanziato con una somma di 500.000 dollari ricavata dalla vendita (direttamente attraverso il sito) di droga, utilizzata poi per assoldare persone da infiltrare nel corso delle proteste per la resistenza di Standing Rock.
Un fascicolo di 187 pagine è stato fatto pervenire agli uffici di Earth First! in Florida, solo punto identificativo del giornale, da dove vengono redatti gli articoli e la rivista trimestrale di quella che da 35 anni (senza membri formali e nessuna espressione gerarchica) rappresenta l’idea di liberazione totale sostenuta e promossa da singolarità e gruppi in tutto il mondo.
La legittimazione delle operazioni di polizia; la criminalizzazione di chi con il proprio corpo difende la Terra dalla devastazione capitalista; la colonizzazione di foreste primarie e terre ancestrali: il provvedimento mosso ai danni di Earth First! rappresenta un attacco diretto alla resistenza condotta da chi lotta per la liberazione della Terra (e quindi di tutt*), un processo volto a facilitare le operazioni estrattive di gas e petrolio da parte delle multinazionali.

Complici e solidali con Earth First!, con quell’idea da cui ha origine il concetto stesso di liberazione (nel senso più amplio, profondo e radicale del termine), un’idea senza cui Earth Riot stessa non potrebbe esistere.

December 5, 2017, New York, NY – On behalf of the environmental magazine the Earth First! Journal, the Center for Constitutional Rights urged a court todismiss parts of a lawsuit brought by Energy Transfer Partners (ETP) and Energy Transfer Equity (ETE). ETP and ETE are part-owners of the Dakota Access Pipeline, and have attempted to sue the broad social movement known as Earth First! for racketeering. The ludicrous allegations in the complaint, filed yesterday, drafted by Trump’s law firm Kasowitz Benson Torres, claim that Earth First! funded a violent terrorist presence at the Standing Rock protests with $500,000 and proceeds from drug sales on the site, and is part of a sprawling conspiracy with Greenpeace and other environmental groups to deceive the public about the environmental risks of pipelines.
Today’s filing points out that the plaintiff pipeline companies themselves admit Earth First! is a “philosophy” or “movement” with “no members” or “formal leadership”; as a matter of law, therefore, it cannot be sued. Trump’s lawyers nonetheless attempted to serve the movement Earth First! by mailing a complaint to the offices of the Earth First! Journal in Lake Worth, Florida, a small collective typically made up of two to five staff members.
“We got this 187-page legal document in the mail that didn’t even mention the Journal,” said Earth First! Journaleditor Ryan Hartman. “Earth First! is a philosophy based on biocentrism, direct action, and not compromising with Earth-destroying corporations when fighting for the environment. It is an idea that for over 35 years has been followed and held dear by individuals and groups all over the world. You can’t sue an idea.”
Advocates say the suits are part of the ongoing labeling of social activism as terrorism, from environmental andanimal rights activism to the Black Lives Matter movement. “I can’t decide what’s the most ridiculous aspect of this case: calling protest against the Dakota Access Pipeline terrorism, or sending the complaint to our clients,” saidShayana Kadidal, senior staff attorney at the Center for Constitutional Rights. “I guess Kasowitz couldn’t find the address for the entire environmental movement, so they settled for harassing an environmental publication with their preposterous claims.”
The filing comes one week after two other environmental groups, Greenpeace and BankTrack, asked a federal judgeto dismiss the lawsuit on the grounds that their work in opposition of the Dakota Access Pipeline is protected free speech.
